Accepting these terms
These terms apply when you use the Legacy Summerville Concrete and Masonry website, ask us for an estimate or hire us for work. By using the site or booking a job with us, you agree to them. If you don't agree, please don't use the site or book work through it.
When we sign a written estimate, proposal or contract with you for a specific job, that document controls wherever it differs from these terms. These terms cover everything that document doesn't.
What we do
We're a masonry contractor in Summerville, SC, and we do brick, block, stone and concrete work for homeowners in Summerville and the cities around it. You can see what we do from the home page and read more about our crew on the about page.
The descriptions on this site are general. They aren't a promise that a particular method, material or result fits your house. We'll only know what your job needs once we've seen it, and sometimes only once it's open.
Estimates and pricing
Our estimates are free, and you're under no pressure to book. An estimate is our best price for the work we can see and the scope we've agreed on, based on what we know on the day we look at it.
Prices can change if the scope changes, if you choose different materials or if we find something that couldn't be seen beforehand, like hidden damage behind brick or under a slab. When that happens, we'll stop and explain what we found and what it costs before we do the extra work. Any change to the price or scope needs your approval first.
An estimate is good for the time it states. After that, material costs may have moved, so we may need to update it before we start.
Scheduling and cancellation
We'll give you a start date and a rough timeline when you book. Masonry and concrete depend on the weather, so rain, heat, cold and wet ground can push a start date or pause the work. Material deliveries, permit timing and the condition of the site can also change the schedule. We'll keep you posted when something moves.
If you need to reschedule or cancel, tell us as early as you can by phone at (843) 376-1285 or through the contact page. If we've already ordered special materials or started work, you may owe for those materials and the work done up to that point, as your written agreement describes.
Payment
Your written estimate or contract sets out what you'll pay, when it's due and any deposit we need before we start. Payment is due on the schedule it gives.
Until a job is paid in full, we may pause further work, and South Carolina law may give us the right to file a lien on the property for unpaid work and materials. We'd much rather talk it through first, so call us if a payment is going to be late.
Our guarantee and warranty limits
We stand behind our work, and satisfaction is guaranteed on every job. If something isn't right, tell us and we'll come back and look at it. Any written warranty for your job, including how long it lasts and what it covers, will be in your estimate or contract.
Our guarantee doesn't cover problems caused by things outside our work. That includes ground settling or soil movement, water and drainage problems we didn't build, tree roots, storms, flooding, misuse, normal wear, repairs or changes by someone else, or materials you supplied. Natural stone, brick and concrete also vary in color and texture, and small hairline cracks in concrete are normal as it cures.
Manufacturers' warranties on products we install come from the manufacturer, under their terms. Apart from what's written in your agreement, we make no other warranties, express or implied, to the fullest extent the law allows.
The information on this website is given as is, for general guidance. We work to keep it accurate, but we don't promise it's complete or current.
Limits on our liability
To the fullest extent the law allows, our total liability for any claim about a job is limited to the amount you paid us for that job. We aren't liable for indirect, incidental or consequential losses, such as lost use of your property, lost income or delays caused by things outside our control.
We're fully licensed and insured. Nothing in these terms limits liability that the law doesn't allow us to limit.
Settling a disagreement
If you're unhappy with anything, call us first. Most problems get sorted out quickly when we walk the job together and talk it through.
If we can't settle it that way, we both agree to try in good faith to resolve it, which can include mediation, before either of us goes to court. Any lawsuit must be brought in the state or federal courts serving Dorchester County, South Carolina, unless the law requires otherwise.
Governing law
These terms, and any job we do for you, are governed by the laws of the State of South Carolina, without regard to rules that would apply another state's law.
Changes to these terms
We may update these terms from time to time, and the version posted on this page is the one in effect. Changes won't alter a written agreement you've already signed with us unless we both agree in writing.
If any part of these terms can't be enforced, the rest still applies.
